Korte Supreme ibinasura ang petisyon ng ABS-CBN laban sa Cease & Desist order ng NTC

Ibinasura ng Korte Suprema ang petisyon ng ABS-CBN na ipatigil ang cease and desist order ng National Telecommunications Commission dahil sa pagiging moot and academic.

Ayon kay Supreme Court Spokesperson Atty. Brian Keith Hosaka, unanimous ang desisyon ng mga mahistrado ng Korte Suprema na i-dismiss ang petisyon maliban kay Justice Priscilla Baltazar-Padilla na hindi nakaboto dahil on-leave.

“I would like to announce that:

The Supreme Court in today’s En Banc session, resolved to dismiss the Petition for Certiorari and Prohibition with Application for TRO and Injunction filed by ABS-CBN Corporation against the National Telecommunications Commission (ABS-CBN Corporation vs. NTC, GR No. 252119).

According to the Court, in light of the supervening denial of the pending House Bills for the renewal of ABS-CBN Corporation’s legislative franchise on July 10, 2020, the Court finds it appropriate to dismiss the case on the ground of mootness. Because of this supervening event, there is no actual substantial relief which ABS-CBN Corporation would be entitled to regardless of the Court’s disposition of the merits of the Petition.

The Justices were unanimous in their decision to dismiss the petition, except for Justice Priscilla J. Baltazar-Padilla who took no part as she was on leave. Senior Associate Justice Estela M. Perlas-Bernabe was the Member-in-Charge of the case.

Nagpasya ang Supreme Court na ibasura ang hirit ng ABS-CBN dahil hindi pinagtibay ng Kongreso ang mga nakabinbing panukala para sa palawigin ang prangkisa ng kumpanya.

Si Senior Associate Justice Estela Perlas-Bernabe ang nagsilbing member-in-charge sa kaso.

Dumulog sa Korte Suprema matapos ipagutos ng NTC na itigil ang operasyon nito noong Mayo dahil sa kawalan ng prangkisa mula sa Kongreso.

Ayon sa network, nalabag ang kanilang mga karapatan dahil sa kawalan ng abiso at pagdinig bago ilabas ng NTC ang CDO.

Pagsikil din daw sa kalayaan sa pamamahayag ang CDO at magdudulot ng serious at irreparable damage sa kumpanya.

Iginiit naman ng NTC sa komento nito na hindi sila umabuso sa pagiisyu ng CDO dahil nasa kapangyarihan  na magpatigil ng broadcasting operations kapag walang
prangkisa mula sa Kongreso ang media network.

Hindi rin daw nalabag ang freedom of press ng ABS-CBN dahil naging irrelevant na ito nang mawala ang pribilehiyo nito na gamitin ang frequency na ipinagkaloob ng estado.
