Court Sheriff, sinibak at pinagmulta ng Korte Suprema dahil sa panununtok sa complainant

Tinanggal sa serbisyo ng Korte Suprema ang isang sheriff sa Olongapo City, Zambales dahil sa pagsuntok sa litigant habang nagsisilbi ng writ of execution.

Sa desisyon ng Supreme Court, sinabi na napatunayan ng complainant na sinuntok ito ni Christopher T. Perez, Sheriff IV ng Olongapo City Regional Trial Court Branch 74 habang isinisilbi ang writ of execution sa forcible entry case ng complainant noong 2019.

Supreme Court : The Court concluded that Sheriff Perez indeed inflicted bodily harm upon Hanif and is hence guilty of grave abuse of authority, which is defined as a misdemeanor by a public officer, who under color of his or her office, wrongfully inflicts upon any person any bodily harm, imprisonment, or other injury.

Ayon sa SC, suportado ng medico-legal certificate na nagtamo ng mga pasa o contusion sa kanang braso ang complainant kung saan ito sinuntok ni Perez.

Isa anilang lubhang pag-abuso ng awtoridad ang ginawa ng Sheriff na inaasahan na batid kung papaano ipatutupad nang epektibo at ng may mataas na propesyanalismo ang mga utos ng korte.

Supreme Court : The Court also underscored how sheriffs, who serve and implement court writs, execute processes, and carry into effect orders of the court, are expected to know the rules of procedure pertaining to their functions as court officers and show a high degree of professionalism at all times.

Bukod sa pagsibak sa posisyon, pinagmulta rin ng Korte Suprema ng P110,000 ang  Sheriff dahil sa gross insubordination matapos na bigong tumugon sa direktiba ng SC na magkomento sa reklamo laban sa kaniya.

Ikinonsidera ng SC na ang ipinataw na parusa ay sa Ika-10 reklamong administratibo laban sa Sheriff.
