Judge, sinuspinde ng 2 taon dahil sa ‘di makatuwirang pagkaantala ng kaso

Pinatawan ng Korte Suprema ng dalawang taong suspensiyon ang isang hukom sa General Santos City dahil sa kabiguan na maresolba ang hawak nitong kaso sa loob ng kinakailangang panahon.

Sa desisyon ng Supreme Court En Banc, napatunayang guilty sa gross neglect of duty si Presiding Judge Oscar P. Noel Jr. ng General Santos City, South Cotabato Branch 35 Regional Trial Court bilang assisting Judge ng Justice on Wheels Program sa Alabel, Sarangani.

Supreme Court : ” In the case of Judge Noel, the Court found him guilty of Gross Neglect of Duty for failing to resolve Criminal Case No. 2642-07 within the reglementary period. The Court noted how the Judge allowed the case to lag for more than 10 years since he took over the case in 2010.”

Ang reklamo laban sa huwes ay nag-ugat matapos na paabutin nito ng higit 10 taon bago maresolba ang kasong rape na hawak nito simula 2010.

Ikinatuwiran ng hukom ang tambak na mga trabaho at kakulangan ng oras para hindi agad madesisyunan ang kaso.

Supreme Court : “ Finally, as to Judge Noel’s justification of voluminous workload, the Court stressed that a judge’s plea of heavy workload, lack of sufficient time, poor health, and physical impossibility could not excuse him or her, since a request could have been easily made to the Court to extend the time to resolve cases.”

Pero ayon sa Korte Suprema, dapat ay naghain ito ng kahilingan para mabigyan ng karagdagang panahon upang maresolba ang kaso na hindi nito ginawa.

Paliwanag pa ng SC, kung walang order of extension mula sa Korte Suprema ay hindi maaaring pahabain ng isang hukom sa sarili nito ang panahon ng pagresolba sa hawak nito na kaso.

Una na ring pinatawan ng SC ng parusa ang nasabing Judge para sa gross ignorance of law sa tatlong magkakaibang insidente.
